Official contest rules

These Official Rules (“Rules”) govern the operation of the Microsoft Insiders in Action: Giving Back Contest (“Contest”). Microsoft Corporation, One Microsoft Way, Redmond, WA, 98052, USA, is the Contest sponsor (“Sponsor”).

2. DEFINITIONS

In these Rules, "Microsoft", "we", "our", and "us" refer to Sponsor and “you” and "yourself" refers to a Contest participant, or the parent/legal guardian of any minor Contest entrant. By entering you (your parent/legal guardian if you are a minor) agree to be bound by these rules.

3. ENTRY PERIOD

The Contest starts at 12:01 p.m. Pacific Time (PT) on November 6, 2018 and ends at 11:59 p.m. PT on January 9, 2019 (“Entry Period”).

4. ELIGIBILITY

To enter, you must be a registered Windows Insider. This award is open to all current Windows Insiders.

Employees and directors of Microsoft Corporation and its subsidiaries, affiliates, advertising agencies, and Contest Parties are not eligible, nor are persons involved in the execution or administration of this promotion, or the family members of each above (parents, children, siblings, spouse/domestic partners, or individuals residing in the same household). Individuals who have accepted employment offers at Microsoft are also ineligible. Void in Cuba, Iran, North Korea, Sudan, and Syria and where prohibited. Minors not eligible.

5. HOW TO ENTER

Step 1: Register as a Windows Insider. If you are not already, you may register at https://insider.windows.com/en-us/getting-started/#register.

Step 2: Complete the Windows Insider Insiders in Action: Giving Back Contest Entry form. This form includes a short written submission and video request.

6. ELIGIBLE ENTRY

To be eligible, the Contest Entry must meet the following content/technical requirements:

  • Video be no more than one (1) minutes in length must not exceed thirty (30) MB in size.
  • Contest Submission Form must include a personal essay of no more than 150 words.
  • Video and essay must be in English only and must be your own original work.
  • You must have obtained any and all consents, approvals, or licenses required for you to submit the content in your entry.

To the extent that Entry requires the submission of user-generated content such as software, photos, videos, music, artwork, essays, etc., entrants warrant that their entry is their original work, has not been copied from others without permission or apparent rights, and does not violate the privacy, intellectual property rights, or other rights of any other person or entity. You may include Microsoft trademarks, logos, and designs, for which Microsoft grants you a limited license to use for the sole purposes of submitting an entry into this Contest; and

Your entry may NOT contain, as determined by us in our sole and absolute discretion, any content that is obscene or offensive, violent, defamatory, disparaging or illegal, or that promotes alcohol, illegal drugs, tobacco or a particular political agenda, or that communicates messages that may reflect negatively on the goodwill of Microsoft.

We are not responsible for excess, lost, late, or incomplete entries. If disputed, entries will be deemed submitted by the authorized account holder of the email address, social media account, or other method used to enter.

7. USE OF ENTRIES

We are not claiming ownership rights to your Entry. However, by submitting an entry, you grant us an irrevocable, royalty-free, worldwide right and license to use, review, assess, test and otherwise analyze your entry and all its content in connection with this Contest and use your entry in any media whatsoever now known or later invented for any non-commercial or commercial purpose, including, but not limited to, the marketing, sale or promotion of Microsoft products or services, without further permission from you. You will not receive any compensation or credit for use of your entry, other than what is described in these Official Rules. By entering, you agree that Microsoft may use your proper name and state or country of residence online and in print, or in any other media, in connection with this contest, without payment or compensation, except where prohibited by law.

By entering you acknowledge that we may have developed or commissioned materials similar or identical to your entry and you waive any claims resulting from any similarities to your entry. Further you understand that we will not restrict work assignments of representatives who have had access to your entry and you agree that use of information in our representatives’ unaided memories in the development or deployment of our products or services does not create liability for us under this agreement or copyright or trade secret law.

Your entry may be posted on a public website. We are not responsible for any unauthorized use of your entry by visitors to this website. We are not obligated to use your entry for any purpose, even if it has been selected as a winning entry.

8. WINNER SELECTION AND NOTIFICATION

Potential winners will be notified by email, mail or phone on or around February 1, 2019.

A panel of qualified judges determined by Sponsor in its sole discretion will select a single entrant with the highest-scoring entry (the "Winner") from among all eligible entries based on the following criteria (“Judging Criteria”):

  • Fit to Contest Theme: We’re looking for compelling stories from highly motivated fans who are passionate about making a positive impact through the power of technology.
  • Quality of Submission: We’ll be considering your ability to communicate effectively and your ability to clearly articulate your passion and what you do to make a difference in your community.
  • Spark: We’re looking for original stories that wow us and have the potential to inspire. The best entries will paint a vivid picture about the cause that you are devoted to and the impact you’ve made. Entries will be judged based on their content (not on how snazzy the video submission is).

In the event of a tie, the entrant whose entry received the highest score for Fit to Contest Theme, as determined by the qualified judges, in their sole discretion, will be deemed the applicable Winner.  Sponsor reserves the right to not select a Winner if, in its sole discretion, it does not receive a sufficient number of eligible and qualified entries.

9. WINNER REQUIREMENTS

Except where prohibited, the potential Grand Prize winner will be required to sign and return a Declaration of Compliance, Liability and Publicity Release, which must be received by Administrator within forty-eight (48) hours of the date notice or attempted notice is sent, in order to claim his/her prize. If a potential winner cannot be contacted, fails to execute and return the Declaration of Compliance, Liability and Publicity Release or provide any other requested information within the required time period (if applicable), does not comply with these Official Rules, or prize is returned as undeliverable, potential winner forfeits the prize.  If a potential winner is disqualified for any reason, the prize may be awarded to a runner-up, if any, in Sponsor’s sole discretion.  Only three (3) alternate winners may be determined, after which the applicable prize will remain unawarded.  Acceptance of any prize shall constitute and signify each winner’s agreement and consent that Sponsor and its designees may use the winner’s name, city, state, likeness, Submission and/or prize information in connection with the Contest for promotional, advertising or other purposes, worldwide, in any and all media now known or hereafter devised, including the Internet, without limitation and without further payment, notification, permission or other consideration, except where prohibited by law.

10. PRIZES

ONE GRAND PRIZE: A $500 American Express gift card we suggest be used toward the purchase of a Microsoft product available in the winner’s market and purchased via www.microsoft.com. Prizes are non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize for one of equal or greater value if the designated prize should become unavailable for any reason. Winners are responsible for all taxes and fees associated with prize receipt and/or use.

11. GENERAL CONDITIONS AND RELEASE OF LIABILITY

To the extent allowed by law, by entering you agree to release and hold harmless Microsoft and its respective parents, partners, subsidiaries, affiliates, employees and agents from any and all liability or any injury, loss or damage of any kind arising in connection with this Contest. All local laws apply. The decisions of Microsoft are final and binding. We reserve the right to cancel, change or suspend this Contest for any reason, including cheating, technology failure, catastrophe, war or any other unforeseen or unexpected event that affects the integrity of this Contest, whether human or mechanical.

12. GOVERNING LAW

This Contest will be governed by the laws of the State of Washington, and you consent to the exclusive jurisdiction and venue of the courts of the State of Washington for any disputes arising out of this Contest. All local laws apply. The decisions of Microsoft are final and binding.

13. WINNER ANNOUNCEMENTS

The winner list will be published on the Windows Insider website within 60 days after winner confirmation is complete.
